Terms of Service

These Terms of Service (“Terms”) govern your use of the Orbyt Job Search CRM application (“Service”) operated by Purecraft (“we”, “us”, “our”) at orbytjobs.ai. By creating an account or using the Service, you agree to these Terms.

1. Account Terms

You must provide a valid email address to create an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must be at least 16 years old to use the Service.

You may not use the Service for any illegal purpose or in violation of any applicable laws. We reserve the right to suspend or terminate accounts that violate these Terms.

2. Subscription & Billing

Orbyt offers a free tier with limited features and paid tiers (Unlimited, Pro, and Ultra) with monthly and yearly billing options. By subscribing to a paid tier, you expressly authorize Purecraft LLC to charge your payment method on a recurring basis at the rate displayed at the time of purchase. You acknowledge that this authorization remains in effect until you cancel your subscription.

Recurring billing consent: By checking the “I agree to the Terms of Service” checkbox and completing your subscription, you provide express written consent to be charged the applicable subscription fee at each billing interval (monthly or yearly) until you cancel. This consent is logged with a timestamp for your records and ours.

Cancellation policy: You may cancel your subscription at any time from Settings → Billing. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of the period you have already paid for. No partial refunds are issued for unused time within a billing period.

Refund policy: All subscription charges are non-refundable except where required by applicable law. If you believe a charge was made in error, please contact us at billing@orbytjobs.ai within 30 days of the charge. We will review and respond within 5 business days. Filing a chargeback with your bank without first contacting us may result in account suspension.

Plan changes: You may upgrade or downgrade your plan at any time. Changes are prorated based on the remaining time in your current billing period. The prorated amount due is displayed before you confirm the change.

Price changes: We reserve the right to change pricing with 30 days' advance notice. Continued use after a price change constitutes acceptance of the new pricing. You may cancel before the new pricing takes effect.

Service description: Orbyt is available in four tiers: Free, Unlimited ($19.99/month or $199.99/year), Pro ($29.99/month or $299.99/year), and Ultra ($49.99/month or $499.99/year). AI features (Scout, Resume Tailor, Contact Parser, voice capture) are available on all plans. Free, Pro, and Ultra include hosted AI with no API key setup needed. Pro includes wellness tools, runway tracker, cross-device sync, and all follow-up reminders. Ultra includes everything in Pro plus 7 autonomous agents, semantic search, weekly reports, and advanced features. Unlimited removes all entity limits but requires your own API key for AI. 3. Acceptable Use

You agree not to:

• Use the Service to store or transmit malicious code
• Attempt to gain unauthorized access to other users' data
• Abuse, harass, or threaten others through the Service
• Use automated tools to scrape or overload the Service
• Resell or redistribute the Service without our written consent
• Circumvent rate limits or security measures

4. Data Ownership

You own all data you enter into Orbyt. We do not claim any intellectual property rights over your content. You may export all your data at any time via Settings → Your Data.

You grant us a limited license to store, process, and transmit your data solely for the purpose of providing the Service to you.

5. AI Features

Orbyt offers AI-powered features that use third-party APIs (OpenAI, Anthropic). Free, Pro, and Ultra plans include hosted AI with no API key setup needed. The Unlimited plan requires you to provide your own API keys. You are responsible for complying with the terms of service of those AI providers. We are not responsible for the accuracy, quality, or content of AI-generated outputs.

Hosted AI (Free, Pro, Ultra): Free, Pro, and Ultra plans include hosted AI powered by Orbyt's server-side API keys. Hosted AI is subject to monthly usage limits on a per-feature basis. Usage limits reset at the start of each billing cycle. We reserve the right to adjust usage limits with 30 days' advance notice. Fair use applies: automated or programmatic abuse of hosted AI features may result in temporary throttling or suspension of AI access.

Unlimited plan (BYOK): The Unlimited plan is designed for power users who bring their own API keys (BYOK) for zero caps and full data privacy. AI requests are routed through your own provider keys.

Voice capture: By using voice capture features, you grant Orbyt permission to access your device microphone when you click the mic button. Audio is recorded in your browser, sent to OpenAI's Whisper API for transcription, and discarded immediately. Orbyt does not store audio recordings. On Free, Pro, and Ultra, voice data is processed through Orbyt's hosted AI. On Unlimited, it flows through your own OpenAI key.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned downtime.

7. Limitation of Liability

To the maximum extent permitted by law, Purecraft and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your specific requirements or that AI features will produce accurate results.

9. Termination

You may delete your account at any time from Settings → Account. Upon deletion, all cloud-stored data is permanently removed. We may also terminate or suspend your account for violation of these Terms, with notice when practicable.

10. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via the application or email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

11. Dispute Resolution

Any dispute arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Delaware, United States.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Purecraft LLC.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction in Delaware.
